  1. General Terms
    All Users Supplemental Terms Jurisdiction-Specific

1.1 Your Relationship With Us
You are reading the terms of service (the “Terms”), which govern the relationship and serve as an agreement between you and us and set forth the terms and conditions by which you may access and use the Platform and our related websites, services, applications, products and content (collectively, the “Services”). Our Services are provided for private, non-commercial use.

For purposes of these Terms, “you” and “your” means you as the user of the Services. The Terms form a legally binding agreement between you and us. Please take the time to read them carefully.

1.2 Accepting the Terms
By accessing or using our Services, you confirm that you can form a binding contract with New Vision, that you accept these Terms and that you agree to comply with them. Your access to or use of our Services is also subject to and consent to our Privacy Policy and Community Guidelines, the terms of which can be found directly on the Platform, or where the Platform is made available for download, on your mobile device’s applicable app store.

If you access or use the Services from within a jurisdiction for which there are separate supplemental terms, you also hereby agree to the supplemental terms applicable to users in each jurisdiction as outlined below, and in the event of a conflict between the provisions of the Supplemental Terms – that are relevant to your jurisdiction from which you access or use the Services, and the rest of these Terms, the relevant jurisdictions’ Supplemental Terms Jurisdiction-Specific will supersede and control.

If you do not agree to these Terms, you must not access or use our Services.

You can accept the Terms by accessing or using our Services. You understand and agree that we will treat your access or use of the Services as acceptance of the Terms from that point onwards.

If you have any violation of the Terms, we have the right to unilaterally restrict, suspend or terminate the Service to you at any time according to the violation, and have the right to hold you responsible. You should print off or save a local copy of the Terms for your records.

  1. Your Account with Us

2.1 Account Creation
You must create an account to access or use our services. When creating an account, you must provide true, accurate and current personal information and update your information in a timely manner to ensure the accuracy and validity of the account information. You cannot assume the identity of another person or provide incorrect information, and you may not create an account for another person without their express permission.

2.2 Account Responsibility
You may not give, borrow, rent, transfer, sell or otherwise license others to use your account in any way, otherwise all liabilities arising therefrom shall be borne by you.

You must notify us immediately when you know or suspect that your password is leaked or there is unauthorized access to your account. You are clearly directing that you take full responsibility for all activities under your account.

We reserve the right to disable your account at any time if you violate any of the terms of this Terms, or if we believe that your account activity may violate the rights of the Service, harm the rights of third parties, or violate laws and regulations.

If your account is disabled for violating our Terms, Community Code, or other terms and policies, you agree to obtain our permission to create a new account. It is at our sole discretion to provide you with permission to create a new account.

You can choose to cancel your account when you no longer wish to use our Services and wish to cancel your account. Once you choose to cancel your account, you will not be able to recover any content or information from your account.

3.1 Age Requirements
You must be at least 13 years of age or the minimum legal age to use the Service in your country. If you are under the age of 18, you hereby represent that you have obtained permission from your parent or legal guardian to use the Service, and please be sure your parent or legal guardian to read this Terms with you.

If you are the parent or legal guardian of the user under the age of 18, by allowing your child to use the Service, you must comply with the Terms and are responsible for your child’s actions on the Service.

You must not be a convicted sex offender. If you use the Service on behalf of a company or organization, you represent that you have the authority to act on behalf of that entity and that entity accepts this Terms.

3.2 Prohibited Conduct
You may not violate or assist or encourage others to violate the Terms or our policies. You shall not engage in any behavior that interferes with or damages the normal operation of the Service, including but not limited to uploading viruses or malicious code, using our service to send spam messages, overloading the service, etc.

You may not modify, translate or reverse engineer, disassemble, decompile, or create derivative works from any of our products or their components. You may not sell or purchase any account or data obtained from us or our services, including, without limitation, attempts to buy, sell or transfer your account or any account information; Requesting, collecting or using information from other accounts.

You may not post any unlawful, misleading, untrue or fraudulent content, including but not limited to defamation, obscenity, hate, money laundering, gambling, threats, harm, violence, self-harm, crime, etc. You shall not violate or prejudice the legal rights of others, including but not limited to copyrights, trademarks, other intellectual property rights, privacy rights, etc.

You may not post any User Content on or through the Services, nor may you transmit to us any User Content that you believe to be confidential or proprietary. If you only own the copyright in an audio work, but do not own the copyright in the musical work contained in that audio work, you may not publish such audio work to the Services unless you have obtained all permissions, approvals or authorizations from the content owner to submit it to the Services.

You may not post any racist or discriminatory content, including discrimination based on a person’s race, religion, age, gender, disability, or sexual orientation. You shall not use new technologies and applications based on deep learning and virtual reality to produce, publish or disseminate false news or information. When you publish or disseminate non-authentic audio and video information produced using new technologies and applications based on deep learning, virtual reality, generative artificial intelligence, or other information content that may cause public confusion or misidentification, you shall identify it in a prominent manner.

3.3 Content Responsibility
You agree that when you view content provided by others on the Services, you do so at your own risk and that the content on our Services is for general information only and is not intended to be advice that you should rely on. You agree that we have no obligation to pre-screen, monitor, review or edit any content that you and other users post on the Service.

You own intellectual property rights in the content resulting from your use of the Service, and you agree to grant us an irrevocable, non-exclusive, transferable, scaleable, unrestricted, free-to-use, worldwide general perpetual license to use, repost, edit, run, reproduce, perform, display or translate your content in accordance with your privacy and application Settings, with respect to such content.   1. The Rights We Reserve
    We have the right to immediately refuse or stop providing you with some or all of the Services, terminate or change the Services, remove or block certain content or information, if in our sole discretion, we determine that:
  • To protect our community or services;
  • You pose a risk or legal risk to us;
  • Any content or information you post violates these Terms of Use or our policies;
  • You violate the legal rights of others;
  • Your account has not been verified after registration, or has been unused and idle for a long time;
  • To avoid or mitigate adverse legal or regulatory effects;
  • Or we are permitted or required to do so by law.

If you believe that our processing is an error, you can lodge a complaint through the appeal function provided by us, and we will review our decision and make a new decision.

  1. Intellectual Property Rights
    We value and protect intellectual property and require you to follow this principle when using our services, and we reserve the right at any time, in our sole discretion, to block access to or terminate any account suspected of infringing intellectual property rights.

If you use content that we own and provide in our products that is protected by intellectual property rights, we reserve all rights in such content. You may only use our copyrights or trademarks or similar marks as expressly permitted by the brand usage guidelines or with our prior written permission.

Unless required by applicable law, you must obtain our written permission to modify, translate, decompile or reverse engineer our products or their components, create derivative works of them, or otherwise attempt to extract our source code.

We have the right to disclose your identity to third parties who claim that any user content you post or upload to our Services infringes their intellectual property rights or privacy rights.

  1. Privacy
    We will not sell, lend or provide your personal information to anyone unless we:
  • Have your prior permission;
  • Relevant laws and regulations or requirements of judicial and administrative organs;
  • Necessary to provide the services requested by the user;
  • Circumstances that may be transferred or disclosed to any third party under other relevant Terms rules.

We do not allow any third party to collect, edit, sell or distribute your information without compensation by any means. If any user engages in the above activities, once found, we have the right to immediately terminate the service Terms with the user and shut down its account.

If you or a third party apply for us to disclose other user information, we have the right to request the applicant to issue a written application according to the actual situation or legal provisions, and the written application content should include the scope, purpose and commitment of the information applied for disclosure.

    We will timely amend the Terms when we update services, or due to changes in laws and regulations, policy adjustments, technical conditions, product functions, security issues and other needs, the revised content constitutes an integral part of this Terms.

We may not be able to notify you in advance, if we need to make urgent changes due to safety, legal or regulatory requirements, but we will let you know as soon as possible.     You shall fully defend, indemnify, and hold harmless us, our affiliates and officers, directors, employees, agents and consultants from any claims, liabilities, costs and expenses including, but not limited to, attorneys’ fees and expenses, arising out of a breach by you or any user of your account of these Terms or arising out of a breach of your obligations, representation and warranties under these Terms.
  2. Exclusion of Warranties and Limitation of Liability
    Except as required by applicable law, we do not represent or warrant to you that: We shall not be responsible or liable for any loss, including, but not limited to, loss of profits, loss of revenue, reduced business opportunities, loss of goodwill, loss of or damage to data, etc. arising out of:
  • Our products are always safe, reliable and error-free;
  • Our products operate without interruption, delay or defect;
  • Our services will meet all your requirements;
  • Any information you obtain through the use of our Services is accurate or reliable.

We cannot predict when our products will have problems. Our platform is for home and private non-commercial use only. You agree not to use our Platform for any commercial or business purpose and we shall not be liable for loss of profit, loss of business, loss of goodwill or corporate reputation, business interruption or loss of business opportunity.

We do not control or manipulate the words or actions of our users and others, and are not responsible for their actions (whether online or offline) or any content they share (including offensive, indecent, obscene, illegal and otherwise objectionable content).

If our services have links to other websites or resources on the Internet, you may be linked to websites operated by other operators, but this does not mean that we have any relationship with these operators.     The Platform contains certain open source software, and each open source software project is subject to its own applicable license terms.

These Terms constitute the entire legal agreement between you and us and govern your use of the Service and completely supersede any prior agreement between you and us with respect to the Service.

You may link to our home page, but only if you do so in a fair and lawful manner and do not damage our reputation or profit from it. If there is no association, approval or endorsement of any kind between you and us, your such link must not imply that it is relevant. We do not guarantee that our services are secure or free of errors or viruses. It is your responsibility to configure your own information technology, computer programs and platforms in order to access our services. You should use your own virus protection software.

These Terms are drafted in Chinese. In the event of a conflict between any translation of these Terms and the Chinese version, the Chinese version shall prevail.

If any provision of these Terms is found to be invalid by any court competent to rule on matters covered by these Terms, that provision will be deleted from these Terms without affecting the remainder of these Terms and the remaining provisions of these Terms will continue to be valid and enforceable.

  2. Supplementary Terms – Jurisdiction-Specific
    In addition to the provisions of these Terms, you are also subject to the relevant laws and regulations of your region. If you use our services in the following areas, you also need to comply with the following terms:

13.1 European Economic Area, Switzerland
If you use our services in the European Economic Area, Switzerland, the European Economic Area consumer law, Swiss regional law will provide you with legal protection.

13.2 Brazil
If you use our services in Brazil, the following additional terms apply. In the event of any conflict between the following additional terms and the provisions of the body of these Terms, the following terms shall prevail.

Representation/assistance from parents and guardians:

  • If you are at least 16 years of age but under 18 years of age, you may use and register an account only with the assistance of a parent or legal guardian, and represent and warrant that you have received assistance in using the Services and agreeing to these Terms;
  • If you are at least 13 years of age but under 16 years of age, you may use and register for an account only on behalf of a parent or legal guardian, and you must obtain the consent of a parent or legal guardian to use the Services and accept these Terms.

13.3 India
If you use our services in India, the following additional terms apply. In the event of any conflict between the following additional terms and the provisions of the body of these Terms, the following terms shall prevail.

Accept the terms:
By agreeing to these Terms and accessing or using our Services, you acknowledge that you have read and understood these terms and agree to be bound by these Terms and our Privacy Policy and Community Guidelines.

Your access to and use of our services:
You may not use the Services to upload, transmit, distribute, store or otherwise (including for the purpose of creating and/or streaming Content) the following User Content:

  • Deceive or mislead the recipient about the source of such information, or communicate any information that is highly offensive or threatening.
  • To threaten the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states or public order, or to incite the commission of any identifiable offence, or impede the investigation of any offence, or insult any other State.

User generated content:
You hereby irrevocably waive your right to raise any objection or other claim with any authority (including any Copyright Board) in connection with the rights granted and licensed to us under these Terms, including any rights under Section 30A of the (India) Copyright Act 1957 or other applicable law. You grant us and all of our group companies, affiliates and successors in title and interest (whether existing or future) the above exemption.

Compensation:
If you need to make compensation to us under these Terms or any court order or ruling, you will have all necessary approvals and consents from the regulatory authority to remit that amount to us.

13.4 Indonesia
If you use our services in Indonesia, the following additional terms apply. In the event of any conflict between the following additional terms and the provisions of the body of these Terms, the following terms shall prevail.

Accept the terms:
By participating in the service, you indicate that you are at least 21 years of age or married or not under guardianship. If you are under the age of 21 and unmarried, your account must be opened in the name of your parent or guardian. In addition, you represent and warrant that you have obtained the consent of a parent or legal guardian, unless you indicate otherwise.

By consent, your parent or legal guardian agrees to be responsible for:

  • All actions you take while accessing the Services;
  • Any fees or charges associated with your use of any of the Services (if applicable);
  • You comply with these Terms;
  • Ensure that your participation in the Services does not, under any circumstances, result in a violation of applicable laws and regulations relating to child protection.

If you do not have the consent of your parent or legal guardian and your parent or guardian is unwilling to open an account in their name, you must stop accessing the services.

Limitation of liability:
If you suffer any loss or damage as a result of our willful misconduct or negligence, the limitation of liability set forth in the above limitation of liability shall not apply.

Age limit:
This service is only available to persons aged 14 years and above in Indonesia.

Language:
These terms are written in English. If there are any inconsistencies or different interpretations between the English text and the translated text, the English text shall prevail. The Parties acknowledge that they have read and understood these Terms and Conditions and that they are entered into freely and without coercion. You acknowledge that you fully understand the language and content of these Terms and agree that you will not use any provisions of law or any implementing regulations to invalidate these Terms.

13.5 Mexico
If you use our services in Mexico, the following additional terms apply. In the event of any conflict between the following additional terms and the provisions of the body of these Terms, the following terms shall prevail.

If you are under the age of 18, you may use the Services only with the consent of a parent or legal guardian. Please ensure that your parent or legal guardian has reviewed, discussed and agreed to these terms with you.
